STONE COUNTY (WLOX) -- Charges have been dropped against the man accused of killing former Stone County Supervisor Duncan Hatten. Bobby Hendrix was charged with capital murder and faced the death penalty.
According to District Attorney Cono Carrana, the charges are being dismissed without prejudice because newly discovered evidence does not support the capital murder charge against Hendrix. A hearing on the matter is set for later this morning in Stone County Circuit Court before Judge Lisa Dodson.
During the investigation into Duncan Hatten's murder, police dogs led them to Hendrix's home on Ponderosa Road. That's in the same neighborhood as the Hatten home. He was questioned that night, but released.
Days later, Hendrix was charged with Hatten's murder. Again, those charges have now been dropped.
