That on or about February 4, 2006, in Harrison County, in the Southern Division of the Southern District of Mississippi, the defendant, Regina Rhodes, then a deputy with the Harrison County Sheriff's Department, while acting under color of law of the State of Mississippi, did willfully assault Jessie Lee Williams, Jr., resulting in bodily injury to him and thereby depriving him of a right secured and protected by the Constitution and laws of the United States, not to be deprived of liberty without due process of law, which includes the right to be free from the use of excessive force by one acting under color of law, in violation of section 242, Title 18, United States Code

Count 2

That on or about a time between February 4, 2006 and July 19, 2006, in Harrison County, in the Southern District of the Southern District of Mississippi, the defendant, Regina Rhodes, having knowledge of the actual commission of a felony cognizable by a Court of the United States to wit: the willful use of unreasonable force resulting in bodily injury and death by one acting under color of law, did conceal the same by (1) writing a false official report and (2) making false statements to investigators, and did not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, in violation of Section 4, Title 18, United States Code.
