HANCOCK COUNTY, MS (WLOX) - Jacobs Entertainment is appealing the Mississippi Gaming Commission's decision to deny approval for a proposed casino site in Diamondhead.
In an appeal filed Wednesday in Hancock County Circuit Court, the developer claims the commission's decision was "arbitrary and capricious" and was handed down without explanation.
The appeal also claims the commission violated state law when it went into executive session for 90-minutes prior to voting on the issue. The developer alleges the commission did not allow comment from Jacobs Entertainment or the public before voting on the application.
The gaming commission denied site approval for two proposed casino projects at its March 16 meeting. RW Development has already appealed the rejection of its Biloxi casino site.
