Son of couple killed in train/bus crash files lawsuit

BILOXI, MS (WLOX) -

We're learning more details about the first lawsuit filed following the deadly crash between a train and charter bus in Biloxi.

Dee Voight, son of Texas couple Peggy and Kenneth Hoffman, is now suing CSX, Echo Tours and Charters, Diamond Tours, TBL Group Inc., and the unnamed driver of the bus, claiming negligence led to the deadly crash.

Peggy and Kenneth, along with two others, died as a result of the collision.

The lawsuit claims the driver of the bus failed to abide by and observe traffic signs, saying the driver did not control the bus. The document claims the driver ignored a low clearance sign before the crossing where the bus got stuck.

The suit also takes aim at CSX over the condition of the road at the crossing.

Voight is seeking monetary relief of $1 million. Attorney Mikal Watts is requesting a trial by jury in the case.
