Singing River retirees prepare for next court battle

JACKSON COUNTY, MS (WLOX) -

The court battle between a group of more than 200 Singing River Health System retirees and their former employer is about to enter another stage.

Harvey Barton, one of the two attorneys representing the retirees, held an informal meeting with them Monday at the Jackson County Public Service Complex.

The retirees don't want to be included in a class action that resulted in the case being settled in federal court in Gulfport on behalf of more than 2,000 former and current employees. They instead want to keep their individual lawsuits against the health system intact, after Singing River tried to dissolve the pension fund two years ago.

"We will have arguments before the 5th Circuit Court of Appeals in New Orleans on January 5th. So we are in the process of getting prepared for that. We've already submitted our brief, the other side is due this week. That's unprecedented how quick this is happening," said Barton.

The hearing shouldn't last long, but it could be weeks before the 5th Circuit issues a ruling on the matter.
