JACKSON COUNTY, MS (WLOX) - Stephen McGilberry's re-sentencing case will not be heard in court Thursday. It has been postponed until next week.
In 1994, McGilberry was 16 years old when he murdered his mother, stepfather, half-sister and her 3-year-old son with a baseball bat in the family's St. Martin home. He was later sentenced to death.
In 2005, the Supreme Court overturned the sentence, saying McGilberry was a minor at the time so he could not be executed. Justices also ruled it was cruel and unusual punishment to give a teenager life in prison with no possibility of parole.
