Mistrial Declared In Child Rape Case

A man accused of raping a 5-year-old girl was granted a mistrial Wednesday. Todd Randall Trower, 37, faces charges of capital rape, kidnapping and burglary.

In 2001, Trower was found guilty of the 1998 abduction and rape of a five-year-old girl. He was given life in prison, plus two 25-year sentences.

Last year, a new trial was ordered after an appeals court found errors in the jury's instruction.

Wednesday, Circuit Judge Robert Krebs gave Trower a mistrial because of the police department's failure to properly inventory DNA evidence.

Prosecutors said they will take the case against Todd Trower back to a grand jury for the third time.
