GULFPORT, MS (WLOX) -

Officials with the Gulfport Police Department tell us investigators are still in New Mexico working to gather information that can link D'Juan Holloway to the shooting death of 19-year-old Ray Howze.

Holloway is still in a hospital near the New Mexico border in Texas. He is accused of shooting at New Mexico police just prior to being captured Monday night.

Police say because of that gun battle, Holloway must be charged in New Mexico before he is extradited to Mississippi the face the capital murder charge.

District Attorney Joel Smith tells WLOX News his office has reached out to New Mexico authorities and requested Holloway be returned to Mississippi and tried on the capital murder charge first.

Holloway is accused of gunning down Howze in the parking lot of M&S Convenience Store on Old Pass Road Sunday night.

After that shooting, Holloway allegedly stole Howze's car and attempted to make his multi-state getaway.
