New trial ordered for woman convicted of murdering George County sheriff

Brandy Nicole Williams was convicted of capital murder and sentenced to life in prison for killing George County Sheriff Garry Welford. However, that verdict has been overturned. And a new trial has been ordered.

The state Court of Appeals released its decision on Tuesday.

Williams and her boyfriend, Christopher Lee Baxter, were convicted in 2012 of capital murder. Each was sentenced to life without parole.

The George County sheriff was struck by a pickup truck in which Williams and Baxter were fleeing from authorities on July 21, 2010. The court order says Baxter admitted to investigators he was driving the truck when it struck Sheriff Welford. He also told police Williams tried to get the driver to stop.

However, the jury never heard that evidence. The appeals court stated, "Had the jury heard Baxter's statements and believed them, Williams could not have been found guilty of capital murder; the jury could instead have found Williams guilty of manslaughter."

The court order says, "Because of this, the trial court abused its discretion and committed reversible error in excluding Baxter's statements."
