BOGALUSA, LA (WLOX) - A proposed class action settlement was announced Tuesday regarding the release of nitrogen tetroxide from a railroad car on the property of Gaylord Chemical Corporation in Bogalusa, LA back in 1995.
A judge has signed the proposed class action settlement between the defendant, Reliance Insurance Company who is the insurer for Gaylord Chemical Company Corporation and the plaintiffs who were all affected by the chemical release.
This proposed settlement was created to resolve various claims of personal injury, property damage and other harm reportedly caused by the nitrogen tetroxide that was released.
According to Bourgeois Bennett, CPAs and Consultants, that proposed settlement also creates a fund for the compensation of certain persons and entities ("Class Members") who did not opt-out of the class, and that filed a proof of claim form no later than June 20, 2000, or were granted specific and special permission by the Louisiana Court to file a late proof of claim and become a class member.

There will be a Fairness Hearing to determine the fairness, adequacy and reasonableness of this settlement on January 14, 2015 at 10:00 a.m. at the Twenty-Second Judicial District Court, Washington Parish Courthouse, Washington and Main Street, Franklinton, Louisiana.
Any Class Members wanting to object to any part of the proposed settlement must submit their objections in writing, postmarked no later than December 31, 2014.
