McDaniel will try to revive his lawsuit that sought to overturn his Republican primary loss to Sen. Thad Cochran. It's not clear when justices will rule.
A judge ruled last month that McDaniel waited too long to challenge results of the June 24 GOP runoff. The judge agreed with Cochran's attorneys, who cited a 1959 state Supreme Court ruling that a candidate must file a challenge within 20 days and McDaniel waited 41.
McDaniel's attorneys say state law was rewritten in the 1980s and doesn't specify a deadline.
McDaniel lost to Senator Cochran in a June 24 runoff election by more than 7,000 votes, but cited election irregularities when he filed his legal challenge.
