Court of Appeals asked to overrule dismissal of casino wrongful death case

BILOXI, MS (Mississippi News Now) -

A wrongful death lawsuit against a Gulf Coast casino has been dismissed.

The suit accused IP Casino of serving free drinks to a medicated man to the point of drunkenness and later death.

Now a US Court of Appeals is being asked to overrule the dismissal.

In 2009, Bryan Lee Glenn collapsed in his hotel bathroom.

It was later ruled that he had died of alcohol poisoning, combined with prescription medications.

State law says that a business can be held liable for serving alcohol to a visibly intoxicated persons if it results in death.

Attorneys for the casino argue that the law is designed to protect those injured by those persons.
