ETOWAH COUNTY, AL (WBRC) -

An Attalla man will be on trial this week for the murder of his wife.

Fifty-six-year old Tommy Roy Smith is on trial for capital murder, accused of strangling his wife, Carla Smith, to death in November 2010.

Gadsden police said at the time Carla Smith, a Riverview Regional Medical Center Emergency Room nurse, was found in the trunk of her car on Brooke Avenue.

Circuit judge Allen Millican has taken the death penalty off the table in this case, since prosecutors are not seeking it.

A jury was chosen today, and opening arguments are Tuesday morning.
