MOSS POINT, MS (WLOX) -

Moss Point resident Lovin Payton has been charged with manslaughter in the death of his older brother, Jerry Payton.

The incident happened on Eastwood Drive in Moss Point Sunday morning.

According to Moss Point Police Chief Keith Davis, Lovin Payton was under the influence of drugs and alcohol when he went to his mother's home and began screaming and arguing with her. The mother asked her son to leave and called police.

Davis said the suspect's older brother Jerry Payton stepped in to defend his mother and a fight started. The suspect punched his older brother in face several times.

Authorities said shortly after the fight was broken up by police, the victim collapsed and died. An autopsy is being done to determine the cause of death.

Lovin Payton's initial court appearance will be held this week.
