Judge allows interrogation video in Olander Park rape trial

TOLEDO, OH (Toledo News Now) -

New developments in a case against one of the two teens accused of raping a teenage high school student at Olander Park.

The two Southview High School students, ages 14 and 17, are accused of raping a 15-year-old girl at the Sylvania park back in September.

A motion to suppress the interrogation of the two males has been denied. A lawyer representing the accused 14-year-old argued he was unjustly denied access to his parents and a lawyer during his interrogation, so it should be thrown out. In court, the judge noted the young man was interrogated after school Sept. 17, with the complaint filed the next day. 

Since the complaint had not been filed at the time authorities spoke with the teen, Judge Connie Zemmelman ruled the two-hour interrogation video should be admitted into trial. 

"I have to follow the law, which means that the parent did not have to have access to him, because the complaint had not yet been filed, and the interrogation was permitted without parental consultation. Therefore, based on all of the forgoing, the motion to surprise is denied," said Zemmelman.

The teen's trial is set to start Wednesday.
