Retired court officer convicted of assault and battery sentenced

NORTHAMPTON, MA (WSHM) -

Retired court officer Jay DiRico was sentenced to three years of probation, six months of which will be served under house arrest.

The 42-year-old was convicted on one count of assault and battery on a police officer back in August.

A jury did acquit him on several other charges including assault with attempt to murder.

The charges against DiRico stem from an alleged attack against Chicopee police Officer Jeffrey Couture back in April of 2012.

Sentencing in the case had been postponed at the judge's request for a pre-sentencing report. That report was requested in part due to DiRico's severe medical conditions.

Tuesday the defense had requested a sentence of two years' probation including six months house arrest saying that DiRico has already suffered enough.

"He's a convicted person, now judge, he's got to deal with that for the rest of his life and I suggest to you that there is no need to incarcerate him," said defense attorney Timothy Mannion.

The prosecution had asked for 2 1/2 years in the house of corrections, with 18 months served in addition to probation.

"I'm disappointed with the outcome," said Couture after sentencing.

Couture tells CBS 3 the whole process has been tough both on him and his family. He says he was hoping DiRico would get a stricter sentence.

"Based on what happened in April of 2012 we were hoping that Jay DiRico would be taken to jail as of today," said Couture.

DiRico's attorney's declined to comment following sentencing.
