Judge denies DuPree's summary judgment; trial begins Tuesday

HATTIESBURG, MS (WDAM) -

Judge William Coleman has denied Johnny DuPree's request for summary judgment in the Hattiesburg election challenge, and there will be a trial by jury

DuPree attorney, Brandon Jones, claimed the outcome of the election should not be determined by a jury, and DuPree supporters erupted in cheers. The judge rejected the motion and the case will go to trial starting Tuesday afternoon. 

However, challenger Dave Ware lost on one key point. The judge denied his request to obtain cell phone records from city employees who allegedly used their city phones to campaign for DuPree.

Judge Coleman announced that jury selection will begin at 10:30am Tuesday and the trial will begin Tuesday at 2:00pm.

Ware lost to mayor Johnny DuPree by 37 votes but says 330 absentee ballots should be thrown out because of irregularities.
