Police: Man gives pot to elderly mother, wrestles naked with officer

ADVANCE, MO (KFVS) -

An Advance man is facing several charges after allegedly giving pot to his 85-year-old mother and wrestling naked with a police officer.

Michael Jess McCleary, 59, of Advance, Missouri was charged Wednesday with two counts of class C felony of distribution of a controlled substance and elder abuse. McCleary was also arrested on an outstanding warrant for sexual misconduct in the second degree and misdemeanor assault of a law enforcement officer.

It is alleged in the police probable cause statement, that McCleary walked into the Advance City Hall/Police Station on Tuesday and requested that the receptionist refill his marijuana medication.

Police say McCleary reportedly dumped the marijuana on the receptionist’s desk and the receptionist called in the chief of police. McCleary reportedly told Police Chief Donnie Bohusack that he needed his medication refilled.

McCleary reportedly told the clerk that "He was from Mars and marijuana was from Mars, the third rock from the Sun."

The chief says he field tested the substance and it tested positive for marijuana.

The chief told McCleary that it was illegal to possess marijuana and the defendant disagreed and stated that he could take it as medication, and "God made marijuana and he could use it."

The Defendant then related to chief that the Defendant had been giving his 85-year-old mother marijuana in place of her prescription medications and that she was "doing much better since he started giving her marijuana."

A urine sample of the McCleary's mother was obtained and it tested positive for THC, a chemical compound in marijuana.

During the incident, McCleary was also arrested on an outstanding warrant for sexual misconduct in the second degree and misdemeanor assault of a law enforcement for an incident with another Advance police officer on May 1.

McCleary was allegedly naked in the front yard of his home in Advance when the officer arrived.

In the police probable cause statement, the officer says McCleary "scratched the officer's face," "punched him" and "spit at him" after the officer drove up to McCleary's home into the patrol car.

McCleary also allegedly tried to take the officer's gun while the officer was trying to get McCleary back inside the home.

McCleary allegedly "exposed his genitals" to the officer and wrestled naked with the officer, after the officer was trying to arrest McCleary.

He was taken to the Stoddard County Jail.
