BAY ST. LOUIS, MS (WLOX) - On Monday, a federal judge dismissed a lawsuit filed against the Waveland Police Department and five officers alleging the use of a taser was excessive force.
In 2011, Blaine Hobgood sued the city alleging his rights were violated when an officer fired a taser at him during a traffic stop in 2009.
Hobgood's suit named the city, the mayor, the police chief and five Waveland police officers.
Judge Louis Guirola dismissed all of the charges against the city, mayor, chief and the officers in their official capacity.
The judge's order said Hobgood could pursue action against one defendant as an individual, the man Hobgood says fired the taser.
At one time, the city faced more than 15 lawsuits over the use of tasers. Several have been settled and others have been dismissed.
