BATON ROUGE, LA (WAFB) -

Baton Rouge Police say they are not ruling out hate crime charges connected to the attack on a white family at a North Baton Rouge gas station. For now, the charges remain the same.

A man, his wife, and their daughter were attacked at the Chevron on Plank Rd. and Scenic Highway.  The attack was bad enough to send the man to the hospital.   Since the news broke, there's been an outcry on social media and talk radio for stiffer charges.

The incident sparked a social network outcry about hate crimes.

"Shock that somebody had the gall to attack somebody the way they did," said Facebook user Alan Reynerson. "It's obvious because he's a white guy."

But Baton Rouge Police Lt. Don Kelly says they have to conduct their investigation based on facts - not Facebook chatter.

The suspect arrested for the attack, Donald Ray Dickerson, has previously been convicted of sex crimes, and has been charged with four counts of armed robbery.  He was convicted on three of those counts and sentenced to 10 years total back in the 1990's.

As far as these new charges, Kelly says we have to wait and see if they escalate.

Dickerson, 41, has been charged with second degree battery for the most recent incident.

Two others, Devin Bessye, 24, and Ashley Simmons, 22, were issued misdemeanor summons.
