AG: Man convicted nearly 20 years ago for fatal crash should report to prison

BATON ROUGE, LA (WAFB) -

The Louisiana Attorney General believes a man convicted in a deadly car crash nearly two decades ago should report to prison to serve his time.

Stanley White was convicted of negligent homicide in 1995 after investigators said he caused a crash on July 31, 1994 on Airline Highway that claimed the life of an eleven week old baby.  

According to Louisiana State Police, White, who was 19 at the time, had a Blood Alcohol Content of a .09, which was legal at the time of the crash. White was sentenced to 24 months in prison but was never taken into custody.

The 23rd Judicial District Attorney's office learned in 2011 while acting on a tip from the Ascension Parish Sheriff's office that White never served his time and filed a motion to have White report to prison. White never did.

A spokesman for the Ascension Parish Sheriff's Office, Colonel Tony Bacala, said no one ever directed the sheriff's office to make an arrest in the case, and that his office first learned about White's case this year.

"There was a breakdown in the process somewhere. We are now examining what didn't happen, what should have happened and what can be done now to resolve it," Bacala said.

"Even though it's been a long time and some people say it's been 19 years, what does it matter? It matters a lot. It's justice," Deville said.

District Attorney Ricky Babin turned the case over to AG's office this year. Director of the Criminal Division, Kurt Wall, said while it's clear someone somewhere didn't do their job, he's not sure the person who let White's case slide through the system will ever be prosecuted.

"None of us were around that long ago. The judges were different, prosecutors were different. I don't know what the breakdown was but we're just going to try to correct it now," Wall said.

The AG's office has asked a judge to order that White report to prison to serve his original sentence.

"It's getting close to Brittany's birthday. On May 20 she would be making 19. So my hopes are I'll be able to go out there (to the cemetery) this year and tell her we finally did receive justice for her," Deville said.

The Ascension Parish Clerk of Courts Office verified it received the AG's motion on Friday.

Judge Thomas Kliebert has been assigned to the case. A hearing date has not yet been set.
