Neighbor captures Scottsdale police shooting on cell phone

An officer-involved shooting last week was all caught on video by a neighbor's cell phone, and CBS 5 News was the only station to sit down with Shane Mosbrucker, who took the video.  

The original shooting took place March 27 when a woman called police at 5:45 p.m. to report an argument she was having with her neighbor over illegally parked vehicles in their area, Scottsdale police Sgt. Mark Clark said.   

Officer Nathan Mullins went to the home in the 8700 block of East Angus Drive and attempted to contact one of the neighbors, and later walked across the street to cite an illegally parked pickup truck, Clark said.

That's when another truck pulled up with who police later identified as Preson Phillips, 72, who lived at one of the homes involved in the dispute.

"It took me a minute to actually comprehend what was happening," said Mosbrucker. "As soon as the officer pulled his gun out, I pulled out my phone and started videotaping."  

Mosbrucker, 19, had a front row seat to the dispute. 

"The truck came barreling down the street, kind of pumped his breaks aggressively," he said.  

In the video you see the officer pull out his gun, but what you can't see is the driver. Police reports show that Phillips pulled a pistol from his holster. 

"The officer went up and was yelling through the closed window to get out of the car and there was no response, and the next thing I know, the officer pulled his gun out."  

Mosbrucker said 11 shots were fired, a total later confirmed by Scottsdale police.  

"The bullets went through the white truck and hit this one," Mosbrucker explained while showing a news team around the area.  

He said he is concerned about the shooting.  

"I felt like it was excessive," he said. "Just because of the amount of time that passed, it was only maybe 10 to 15 seconds before the shots were fired."  

Scottsdale police said officers are trained to fire until the threat is neutralized and that Mullins, a seven-year veteran, is on leave until an investigation is complete.  

Scottsdale police also have a copy of the video and are reviewing it.
