Arrest affidavit reveals details behind murder

SMITH COUNTY, TX (KLTV) -

New details have emerged in a Smith County murder last summer.

The brother of a victim told sheriff deputies during the investigation that he heard a confession.

Natalio Gurrusquieta is now behind bars in Smith County, charged with the murder of Jose Alfredo Sanchez. His bond is set at one million dollars.

During the investigation of Sanchez's death, Sanchez's brother reported to authorities that he heard Gurrusquieta said in Spanish quote "He's dead and I'm alive. I got the last laugh."

"All I know is an argument ensued, there was alcohol involved, and I think it just escalated and after that, several people started shooting. It ended up in three individuals being shot," explained Sheriff Larry Smith.

Deputies said they found Sanchez shot dead with multiple gun shot wounds. Inside a home on the property, deputies found Gurrusquieta with multiple gun shots wounds in his stomach area and a wound on his head.

Deputies learned that another man had been shot in the arm and taken to a hospital.

A crime scene reconstruction report involving DNA and blood evidence reveals that Sanchez was shot once and then again when he was either in the process of going down or crawling.
Investigators said that means he was not a threat, and they said this evidence reveals that the shooters cannot claim self-defense.

Gurrusquieta is behind bars charged with murder, but Smith believes he wasn't alone.

"There is a second person that we anticipate having in custody within the next day or so," Smith said.

Smith said once arrested, he too will face a charge of murder.
