BILOXI, MS (WLOX) - A man sentenced to die for killing a Biloxi convenience store owner in 2007 won a victory from the state supreme court this week.
The justices have ordered the trial court to take another look at whether the statement from Jason Lee Keller should have been allowed as evidence in his trial.
Keller was convicted in 2009 of killing 41-year-old Hat Nguyen at her business on Popp's Ferry Road. Lee was in the hospital recovering from gunshot wounds when he gave three statements to officials. Two of them were not allowed as evidence.
In ordering the review of Keller's statement, the justices said they must make sure that statement was not coerced.
The trial court has 60 days to hear the case on Keller's statement.
