TYLER, TX (KLTV) -

A child, who was taken to an East Texas hospital this weekend with a blood alcohol level two times the legal limit for adults, is expected to be released from a Dallas hospital.

The child, identified as one-year-old Demarion Crow, was seen March 17 at East Texas Medical Center and medical staff notified police the child had a blood alcohol level of more than .2.

Crow was flown from ETMC to Children's Hospital in Dallas.

Ronchekal Demune Yon was arrested in connection to the incident. According to the arrest affidavit, Yon is the boyfriend of the baby's mother, Quantara Hawkins. According to Hawkins there were two other people at the house at the time of the incident, but Yon was the only one drinking alcohol. Hawkins told police she did not see the baby drink anything but noticed him acting funny and smelling of alcohol.

According to the arrest affidavit, in a text message, Yon tells Hawkins that Demarion did drink from his cup. He says, "I messed up n didn't pay attention wen [Demarion] grabbed my cup."

A witness told police Yon was intoxicated and handed the cup, containing straight vodka, to Demarion.

In an interview with police Yon denied letting Demarion drink out of the cup on purpose, but he did tell police that in the past he allowed Demarion to take a drink of beer.

Yon is charged with injury to a child and currently booked in the Smith County Jail.

Child Protective Services is now investigating the case.
