DIAMONDHEAD, MS (WLOX) -
Diamondhead will become a city. Thursday the Mississippi Supreme Court denied the latest request from opponents of incorporation who asked the court to reconsider its decision saying opponents did not get proper notice of the trial.
Opponents filed a motion in November to the court arguing although they knew about the original trial date in September 2008, a new trial date was never published in the local newspaper as required by law.
"I think this is good for the future of Diamondhead because we can now control our own destiny," Interim Diamondhead Mayor Chuck Ingram told WLOX News.
An official date for incorporation has not yet been set however attorney for Diamondhead incorporation Jerry Mills says once a mandate is issued by the Supreme Court the incorporation must be complete in 10 days.
Mills said he expects a mandate to be issued by next Thursday.
