Development Commission Loses In Court

The Harrison County Development Commission lost a court battle concerning the release of public records. In his ruling, chancery judge James Persons fined the commission $100 for breaking the open records law, and awarded Henry Kinney more than $8,000 in attorney's fees.

Kinney, who lives near the Long Beach Industrial Park, sued the commission in 2000 concerning the operation of the park.

According to the suit, commission officials said Kinney would have to pre-pay to look at the records, and then refused to turn them over.

Commission attorney Harry Allen says he's disappointed with the ruling, and is not sure if commissioner's will appeal the ruling or ask for a modification.
