Man attacked after trying to stop robbery

ST MARTIN, MS (WLOX) - Three people are jailed in connection with an on a convenience store customer in St. Martin.

The assault happened Saturday night at the Kangaroo gas station on Tucker Road. Jackson County Deputies were called to the station about 8:30 p.m. and found a man in parking lot with severe head injuries.

Investigators said the man was beaten when he tried to stop two men from stealing beer. The attack was captured on the store's surveillance tape.

According to the store's attorney, James Heidelberg, the tape clearly shows the customer talking to the two suspects inside the store and the attack in the parking lot.

Two Vancleave men are under arrest.

Joseph Franklin Waits, 28, is charged with aggravated assault and probation violation. Authorities said Waits was serving probation on an armed robbery charge.

Kyle Forehand, 20, is charged with aggravated assault.

A third man was arrested Tuesday, charged with witness tampering in the case.

Heidelberg, told WLOX News, the day after the attack, a man came to the store and tried to intimidate the manager. Investigators arrested 47-year-old Scott Garbutt on Tuesday. Garbutt is charged with tampering with a witness and probation violation because he was on probation for a drug charge at the time of his arrest.

The customer injured in the attack has not been identified. The Jackson County Sheriff's Department said the man was taken to Biloxi Regional Medical Center, then transferred to USA Medical Center.

"We're concerned about the customer and doing the best we can to check on his condition," Heidelberg told WLOX News.

WLOX News has learned the victim has been released from the hospital. 

All three suspect are in the Jackson County jail.
