D'Iberville to appeal annexation ruling


D'IBERVILLE, MS (WLOX) – The D'Iberville City Council voted Tuesday to appeal a judge's ruling in an annexation lawsuit with the City of Biloxi.

The two cities went to court after each city sought to expand boundaries north; incorporating areas of Harrison County. Last week, a judge awarded each city about 2.5 miles of land; basically splitting the disputed area between the cities. Biloxi will expand to include the area around the new Highway 67. D'Iberville's additional area includes Highway 15. 

D'Iberville City Manager Michael Janus said the city council voted to have its attorneys appeal the annexation ruling to the Mississippi Supreme Court. 

"The mayor and city council feel strongly in their belief that the City of D'Iberville's future growth and development plans were diminished by the recent ruling," Janus said in an email.

"They feel that the city presented a sound, strong case as to why this area should be included within the boundaries of the city," Janus said.

Biloxi leaders said the appeal was expected. 

"As far as the portions of the ruling in Biloxi's favor, the court considered the evidence and the facts, and ruled accordingly," said Biloxi spokesman Vincent Creel.

"The court also seemed to go to great lengths to thoroughly explain the legality and soundness of its rulings in Biloxi's favor," Creel said in a statement released after D'Iberville announced its appeal.

Creel said the City of Biloxi will be evaluating all of its options.
