Biloxi pharmacist faces new trial June 1

GULFPORT, MS (WLOX) - A jury found Biloxi pharmacist Nick Tran not guilty on 43 counts of a federal indictment Friday, but his time in court isn't finished.

Jurors were hung on 11 other counts, for which Tran will be retried on June 1. That means a whole new trial and a new jury.

Tran was accused of taking part in a pill mill operation by filling hundreds of illegal prescriptions at his Division Street Pharmacy. According to testimony, most of those prescriptions were written by Dr. Thomas Trieu and Dr. Victoria Van, a husband and wife medical team that ran the Family Medical Clinic next door to Tran's pharmacy. Both Trieu and Van will be sentenced April First.

Tran was named in 54 counts of a 59 count federal indictment that also included charges against Doctors Trieu and Van, and one other defendant.

On WLOX News at 10pm, Steve Phillips will have reaction from both the defense and prosecution on Friday's partial verdict.
