D'IBERVILLE, MS (WLOX) - A D'Iberville man is under arrest, charged in a boating accident that left one man dead and another in critical condition.

According to the District Attorney's office, 26-year-old Conelly Bernius was taken into custody at 6:30 Tuesday evening at the home of a friend in Gulfport.

Bernius is charged with one count of boating under the influence causing death. He also faces a single count of boating under the influence causing bodily disfigurement. Both charges are felonies and both carry a maximum ten year prison sentence.

Authorities say this past Saturday on the Tchoutacabouffa River, the boat Bernius was driving slammed into another boat, killing 24-year-old Chris Webb of D'Iberville. Bernius had been pulled over by the Department of Wildlife, Fisheries and Parks for a routine safety check when he suddenly sped away. That's when investigators say he hit Webb's boat.

The District Attorney's office also told WLOX News Bernius had a blood alcohol level of at least .10. That's above the legal limit of .08. No drugs were found in his system.

Bernius is being held in the Harrison County jail under a $250,000 bond.
