PASCAGOULA, MS (WLOX) - A former Singing River heart surgeon made his initial appearance in court Tuesday after he was arrested on drug charges in California.
Dr. David Bruce Allen is charged with one count of cultivation of marijuana and one count of sale of a controlled substance. Last month, officers raided his property known as the "blue hole" in the Helena community.
Officers say they found hydroponic marijuana, marijuana seeds, a room built to cultivate it, along with growing equipment and about $1,000 worth of hashish.
They say they also found seven guns in the raid, and arrested his sister and her husband.
Allen's attorney said his client was in California at the time of the raid. This first appearance marks the beginning of the legal process for Dr. Allen.
"He wasn't even in the state. He was in California at the time that the affidavit says he committed a crime in the state. So they can always amend the affidavit, but they allege that he was committing crimes in Mississippi in February 2009. So we plead not guilty," David Allen's attorney Calvin Taylor said.
"I'm not going to debate what his lawyer says. You know, that's for the courts," Lieutenant Curtis Spiers said. "It's an ongoing investigation, but obviously he wouldn't have been brought back from California and incarcerated with a formal charge if we did not have enough for a case."
Allen is currently out on bond. His case will be heard by a grand jury.
